FACT CHECK: Viral Post Misleads On Charges Nebraska Teen Faced For Ending Pregnancy With Abortion Pills

A screenshot of a tweet shared on Facebook purports Nebraska teenager Celeste Burgess faces up to five years in prison for ending her pregnancy with abortion pills.

Burgess was sentenced to 90 days in jail for illegally concealing human remains, according to The New York Times. The teenager’s mother, Jessica Burgess, faces up to five years in prison for furnishing false information to a law enforcement officer and removing or concealing human remains, the outlet indicated.

Fact Check:

Burgess was sentenced for having an illegal abortion back in 2022, when she was 17 years old, in court Thursday, according to CNN. Burgess pleaded guilty to the charge of concealing human remains earlier this year for disposing the fetus, The Associated Press reported.

“A Nebraska teenager has been sentenced to jail and charged as a felon after ending her pregnancy with abortion pills. She faces up to five years in prison,” the screenshot of the tweet shared via the Facebook post purports. The post has received over 7,000 likes as of writing.

The claim is misleading, however.

Jessica Burgess did order abortion pills online and gave them to Celeste. The women buried the fetal remains themselves and were charged when police obtained their private Facebook messages indicating they were planning to end the pregnancy and “burn the evidence,” The Times reported.

Burgess violated Nebraska’s abortion law when she took the abortion pills to end her 24-week pregnancy, according to USA Today. The law only allowed for abortions up to 20 weeks at the time before shortening its ban to 12 weeks following the U.S. Supreme Court’s overturning of Roe v. Wade, the outlet indicated.

Celeste Burgess told investigators she’d had a miscarriage and disposed of the fetus with her mother’s help before they discovered the Facebook messages, the New York Post reported. (RELATED: Does The Department Of Defense Pay For Abortions?)

In addition to the aforementioned charges, Jessica Burgess faced charges of performing or attempting an abortion at more than 20 weeks and performing an abortion as a non-licensed doctor, according to USA Today. Madison County Attorney Joseph Smith filed the charges, but two charges against the elder Burgess were dropped as part of a plea agreement, the outlet indicated.
