FACT CHECK: Did Cruz Say Merrick Garland ‘Will Rot In Jail’?
A video shared on Facebook claims Texas Republican Sen. Ted Cruz said that Attorney General Merrick Garland would “rot in jail.”

Cruz recently wrote a letter warning Homeland Security Department Secretary Alejandro Mayorkas of possible impeachment, Fox News reported. The letter was in relation to the secretary’s handling of the southern border crisis, calling his response a “gross dereliction of duty,” the outlet reported.
The Facebook video, viewed over 12,000 times, claims Cruz told Garland he was going to jail, “You Will Rot In 𝐉𝐀𝐈𝐋” – Sen Ted Cruz 𝐋𝐄𝐀𝐊𝐒 New Evidence 𝐈𝐌𝐏𝐋𝐈𝐂𝐀𝐓𝐈𝐍𝐆 Merrick Garland,” the video’s caption reads.
The caption is inaccurate. Neither Cruz nor the Justice Department have mentioned any such documents on their verified Twitter accounts or have issued any press releases regarding the alleged exchange. There are likewise no credible news reports suggesting the Texas senator made such a remark about any sitting official.
Cruz has previously called for Garland to be impeached as well as Mayorkas, calling their policies an “abuse of power” while also targeting the Federal Bureau of Investigation.

The video is also irrelevant to the caption. The footage is from a November 2021 Senate session featuring Cruz questioning Mayorkas on illegal immigration. Cruz pressed for an answer to how many released migrants will return for their court hearing and statistics on the number of illegal border crossings there have been in 2021.
