The full case against the two was not dismissed. There will be a new hearing in December.
Fact Check:
Andrew Tate and his brother, Tristan, have become social media celebrities in recent years for their brash attitudes and lavish lifestyles. The two were arrested in Romania in 2022 on charges of human trafficking and rape, although both deny any wrongdoing and claim that they are victims of a conspiracy. The Tates have been in and out of jail and house arrest, but are also still wanted in the United Kingdom on sexual abuse charges, and can face extradition under a ruling by a Romanian court.

The claim is incorrect. The Bucharest Court of Appeals has returned the case back to prosecutors, citing numerous “irregularities” and striking certain pieces of evidence from trial. The court agreed that some descriptions off improper acts were incorrectly described by female witnesses, among other information. The prosecution has five days from the ruling to pursue the case with revised charges or drop it altogether, while the two will be back in court Dec. 10.
Attorneys for the Tate brothers, both dual U.S and British citizens currently residing in Romania, have still called this initial ruling a win for their side. Calling it a “monumental victory,” they claim this ruling to be a step towards proving innocence for their clients.
